I am in exaactly the same position! I have a British passport and my wife has a UK Biometric Residence Permit, but the issue also is that her permit is extended under section 3C of the Immigration Act 1971 because having applied for the renewal we are told that updated BRPs are delayed by HRMC.

I am also keen to know whether we will be alowed in (relying on the expired BRP and section 3c).

Can anybody help us!

Thanks David. Not sure about your specific case Steve, seems to be a special case! I've emailed Visit Gibraltar and the border agency. No reply from the Border Agency. Visit Gibraltar directed me to their website which in turn directs you to the Gibraltar Border Agency's website. From spending hours checking online all I can surmise that Gibraltar's usual visa policy applies and there's no further restrictions to entry (apart from travel history restrictions). There hasn't been passport restrictions mentioned anywhere online. Some have stated online that it's soft border control for UK arrivals as you're flying from one part of the UK to the other.

Provided your documents are in order , the entry requirements are no different to what they would have been in pre COVID times.

One of the frequent questions I get is which countries can I visit with a UK visa. The short answer is the UK. The long answer is you can travel to 40 countries and territories VISA-FREE with UK visa.

I encourage you all to get a US visa or at least a Canada visa first. Both these visas are long-term visas. These visas offer VISA-FREE travel to quite a few countries. But if you happen to have a UK visa or applying for one, then it is still better than not having any visas at all. There are about 40 countries and territories you can visit with a UK visa.

UK tourist visas are mostly short-term (C-Type) visas valid for 6 months. The UK does issue long-term visas for 5/10 years but it would cost an arm and a leg.

The UK visa application is not the most difficult, but it can be stressful due to its lengthy processing times and lack of customer service.

• Permitted visas: All valid used/unused multiple-entry Tier 1, 2, 4 or 5 visas (student and work only)
• Permitted residence permits: All valid ILR and BRPs
• Entry granted: 30 days
• IMPORTANT: UK standard visitor visas are NOT accepted
• UK Tier 1, 2, 4, 5 visas or BRPs must be valid for at least 3 months from the day of arrival

• Permitted visas: All valid used/unused LONG-TERM multiple-entry UK visas, issued for at least for 3+ years
• Entry granted: 7 days
• UK visa must be a long-term visa issued for 3 or more years, visas issued for less than 3 years are not accepted
• After entering Kyrgyzstan this way, you can only reenter Kyrgyzstan again after 21 days

39. Philippines

• Passport must be valid for at least 6 months beyond the date of departure

40. Singapore

• Entry granted: 96 hours (4 days)
• Visa is NOT EXEMPT but are eligible to obtain Visa Free Transit Facility (VFTF) upon arrival
• Must be traveling to or from the country of passport. Example: Must be traveling to a third country from India via Singapore or traveling to India from a third country via Singapore. An example itinerary would be India-Singapore-Bali or Bali-Singapore-India.
• Both arriving and departing flights in Singapore must be on the same itinerary

BRP vs. Residence Card vs. ILR

A UK residence permit is an immigration authorization that guarantees an individual can legally live, work, access certain public benefits and even settle down in the country but with nationalities of other countries. Here are some common types.

Biometric Resident Permit

BRP is issued to those who:

• apply to enter the UK for more than 6 months, or
• extend their visa for over 6 months, or
• intend to settle in the UK, or
• transfer their visa to another passport, or
• apply for travel documents from the Home Office.

This plastic card is usually valid for 10 years. There is a chip on it that is used to prevent identity theft and misuse.

UK Residence Card

It is known as a European Economic Area (EEA) biometric residence card (BRC), but it is no longer available since Brexit. EU citizens have to obtain other types of permission to continue staying in the UK, such as EU Settlement Scheme.

Indefinite Leave to Remain (ILR)

ILR is also called a UK permanent residence permit, allowing the holder to live, work, study and engage in business activities in the UK without restriction of stay and visa extension. It is issued to those who:

• have been legally staying in the country for a qualifying period, or
• have family (spouse, partner, parent, child, or other relatives) in the UK, or
• are a Commonwealth citizen, or

Travelers of all nationalities are eligible to enter Albania as long as they present a passport valid for at least 3 months and a valid, multiple-entry UK visa stamped on the passport or a separate valid UK resident permit. Please don’t stay over 90 days during a 6-month period.

Foreign visitors can take a visa-free travel to Armenia with passports issued by the countries listed in the table and a valid, multiple-entry UK visa or valid UK resident permit. The passport must be valid for at least 90 days or during your stay in Armenia which should not exceed 180 days in a year.

People of all nationalities are allowed to enter this country without a visit and stay for 90 days within a 180-day period when showing a valid, multiple-entry UK visa on their passports or a valid UK resident permit. The passport must be valid for at least 3 months and has at least 2 blank pages at the time of entry.

● Gibraltar

International visitors with a valid, multiple-entry UK visa issued for at least 6 months or a valid UK resident permit issued for at least 12 months are exempt from applying for a visa to enter Gibraltar regardless of their nationalities. The visa-free duration of stay should be less than 180 days.

● Montenegro

All nationals around the world enjoy a 30-day vasa-waiver stay in Montenegro with a valid, multiple-entry UK visa or valid UK resident permit and a passport valid for no less than 3 months.

● North Macedonia

Valid, multiple-entry UK visa, UK BRP or UK ILR holders can stay in North Macedonia for 15 days without an extra visa. The validity of the UK visa or residence permit must be 5 days longer than the expected period of stay in North Macedonia. Make sure your passport does not expire in 3 months when you arrive.

North America

UK permanent residence permit (ILR) holders and valid/unexpired UK visa holders can travel to Mexico without a Mexican visa despite their nationalities. Permitted visa-free stay does not exceed 180 days. The authority might request foreign visitors to show proof of the intended duration of stay and purpose of travel, such as onward or returning air ticket, and travel itinerary.

Central America

People of any nationality with a valid used multiple-entry UK visa or UK residence permit can visit the Republic of Panama and stay for a maximum of 30 days. Here are some extra entry rules.

• A UK visa or permit must have been used to visit UK before entering Panama.
• The UK visa or permit must be valid for at least 6 months upon arrival.

Caribbean Areas

The maximum period of stay as tourists should not be over 30 days. The passport or other travel documents must be valid at arrival and during your stay in Aruba.

It is a British overseas territory, allowing all nationals with valid multiple-entry visas, ILR, BRP to enter without an additional visa. The duration of stay should not exceed 30 days. At the date of leaving Bermuda, the passport and UK visa or residence permit must have 45 days of validity.

Holders of a valid residence permit for the United Kingdom are exempted from the visa requirement. The length of stay is usually 14-30 days. On the date of entering Bonaire, your passport must be valid for at least six months.

● Cayman Islands

As a British territory, it welcomes travelers with a valid ILR or BRP and a passport issued by China, India and Jamaica to take a 30-day visa-free trip. You must arrive from the UK instead of from a third country. 

Foreign nationals of all nationalities and legal UK residents can stay in Curacao for 90 days without a visa. You must present a passport and a valid UK visa, ILR or BRP to prove your citizenship and residency.

● Dominican Republic

Multiple-entry UK visa and UK residence permit holders are permitted to enter Dominica and stay for 90 days without visas regardless of nationality. A Tourist Card and passport with at least 6 months of validity is required. If you travel by land or sea, you should pay extra fees to purchase the card.

● Sint Maarten

UK residence permit holders (either temporary or permanent) are granted a 30-day trip without a visa. Make sure your BRP or ILR is valid for at least 30 days upon arrival.

● Turks and Caicos 

This British territory is open to UK multiple-entry visa holders and UK long-term or permanent residents. If you are eligible, you can stay for 90 days at most.

South America

According to Peru entry requirements, if you are a Chinese or Indian national with a valid multiple-entry UK visa or UK permanent resident card (ILR), you can enter the country without a visa and stay for 180 days. Make sure your UK visa or ILR is valid for 6 months or longer from the date of arrival.

● Philippines

India nationals with a valid multiple-entry UK visa, ILR or BRP are not required to apply for a visa to visit the Philippines, but you cannot stay for more than 14 days. The officer will check whether all travel documents are valid during your stay and whether your passport is valid for at least 6 months from the date of departure.

● Singapore

As a popular tourist destination, Singapore welcomes UK temporary and permanent residents with Chinese and Indian nationality to enter and stay for no more than 96 hours (4 days) without a visa, but you must be arriving from or returning to your country of passport.

● South Korea

Transit passengers with UK residency can enter the country without a visa and stay for 30 days. They must be arriving from 26 Schengen countries, Cyprus, Ireland, Romania or UK or arriving in one of these 30 European countries after leaving South Korea. Please note that nationals of the following 24 countries are not eligible for this policy.

● Taiwan, China

All ILR or BRP (valid/expired) holders with nationalities of Cambodia, India, Indonesia, Laos, Myanmar, and Vietnam are eligible to stay in Taiwan for 14 days with a visa, but you have to apply for ROC Travel Authorization Certificate online before arrival, which is free of charge and valid for multiple entries in 90 days.

Temperatures can rise well above 30°C in summer. Gibraltar has an average of 300 days sunshine a year and the climate is Mediterranean. The sub-tropical sun of North Africa is tempered by gentle sea breezes in summer. In January, daytime temperatures are usually around 16ºC to 18ºC and it is quite possible to top up a tan. Rainfall is mostly limited to early or late in the year.

The monetary unit is Pound Sterling with notes issued by the Government of Gibraltar. The legal tender is Gibraltar Government notes and coinage, though Bank of England notes and coinage are equally welcome. Most establishments accept Euros, but you will often get more favourable rates of exchange if you change your foreign currency at one of the numerous banks and bureaux de change in town. Banks are generally open Monday – Friday from 09:00 – 16:00. Bureaux de change open from 09:00 – 18:00. All major credit cards are widely accepted in shops, restaurants and hotels.

Electrical power is 220/240 AC, and sockets are the same as those in the UK, i.e. 3 flat-pin plugs. An adapter is needed for appliances from Europe.

Gibraltar is approximately two and a half hours flying time from London.

British Airways operates scheduled daily flights from London Heathrow and London Gatwick (May - September in 2018) to Gibraltar. For reservations and information: www.ba.com

Gibraltar is part of the AEU by virtue of its relationship with the United Kingdom. If you or any of your dependants are suddenly taken ill or have an accident during your visit to Gibraltar, you can see a doctor or get hospital treatment on the same terms as Gibraltar residents.

EU Nationals can show proof of entitlement by producing Form E111, which can be obtained from the relevant department in their home country. UK Nationals need only show their UK passport. Doctors, dentist and prescriptions and free treatment under the Group Practice Medical Scheme is available at the Primary Care Centre. A nominal fee is payable for House Calls.

A small charge is made for each item of medicine prescribed under the scheme. Dental treatment is not available under the scheme, but an emergency service is available at the Primary Care Centre for which only a nominal fee is charged. Hospital Treatment Free treatment in public wards is available at St. Bernard´s Hospital.

Please note that you will be eligible for emergency treatment only for illnesses or conditions that arise during a temporary stay in Gibraltar. You will not be covered if you go to Gibraltar expressly for treatment of a condition that arose somewhere else. Private treatment is not covered.

No specific vaccinations are required for Gibraltar.

All cats and dogs, belonging to and accompanying residents of EU Member States, can enter Gibraltar provided that they are in good health and covered by a valid certificate of rabies vaccination. In the case of primary rabies vaccination, this must be administered not less than 28 days prior to the dog or cat arriving in Gibraltar. Cats and dogs on board yachts visiting Gibraltar are not permitted to come ashore unless they are properly vaccinated against rabies, as stated above, and the owner can prove that the cat or dog has not visited any country outside the EU during the preceding six months. Each hotel has its own rules regarding pets, please contact directly for details.

Passports are required by all visitors to Gibraltar, except EU nationals who are in possession of a valid national identity card.  All other nationals require a passport or other recognised travel document. Stateless persons or nationals from certain countries require a visa to enter Gibraltar. As a general rule, those persons who require a visa for entry into the United Kingdom will also require a separate visa for entry to Gibraltar.

Gibraltar is outside the Schengen area. Persons who hold a Schengen visa and intend to enter Gibraltar from Spain should ensure that they will be able to return to Spain.

At the passport desk a Gibraltar Borders and Coastguards Agency Officer will ask to see your passport or travel document plus any supporting documentation necessary for your visit.  Please note that your passport or travel document must not expire during your planned visit to Gibraltar.

Commercial outlets and shops are normally open between 10:00 – 19:00 on weekdays and from 10:00 – approximately 15:00 on Saturdays. Most shops are normally closed on Sundays and Public Holidays, however the main large food stores are open throughout the seven days of the week and some small shops may also decide to open for trade. The Public Holidays in Gibraltar are the same as those observed in Great Britain, although there are an extra four days.

The entry into Gibraltar is free. Should you wish to enter Gibraltar in your vehicle be aware that you may encounter traffic congestion at peak times. Should you choose to visit at peak times a parking space may also be difficult to find. A good alternative might be to park in Spain and walk across the border and then walk, take a public bus or taxi. It is forbidden to access the Nature Reserve, Upper Rock in your car.

Traffic laws are strictly enforced and parking in unauthorised areas could result in your vehicle being towed away or immobilised. In Gibraltar it is mandatory to drive on the right.

EXPLAINER: The latest rules around visitors to Gibraltar

WITH Gibraltar benefitting from the UK’s advanced vaccination program, the country has returned to ‘normal’ in many areas, but what is needed to visit the iconic region?

Firstly, Gibraltar is open to visitors on a whole, but is mandated by a system similar to the UK’s traffic light system when it comes to what is needed to enter, but with both the UK and Spain on Gibraltar’s green list, travel restrictions are relatively low.

All arrivals will require some sort of COVID-19 test upon arrival, either a Rapid Flow Test (RFT) or a full PCR test, the former being announced as free of charge for Green list countries by the Gibraltar government last week.

All other arrivals will have to pay £30 for a RFT online when booking.

These can be booked via www.covidrapidtest.gi and will take place at the Testing Service Unit at Gibraltar airport.

These tests are required for any traveller arriving from GREEN list countries and have not visited an AMBER or RED list country in the past 14 days.

They are also required for those who have visited amber or red list countries, but have received both does of the COVID-19 vaccine.

Results of the test are available within 30-60 minutes and travellers will receive confirmation via text and an online certificate will be sent.

WHAT ARE THE REQUIREMENTS FROM EACH TIER COUNTRY? (non-vaccinated)

Arriving from a GREEN list country:

• Travellers must book a free Rapid Flow test before arriving in Gibraltar.
• The RFT must be taken within 24 hours of arrival
• If staying for more than seven days, a second RFT must be taken on Day 5

Arriving from an AMBER list country OR have visited an AMBER list country within 14 days:

• You must perform a COVID-19 PCR test before arriving into Gibraltar, either via the Gibraltar Health Authority for GHA card holders or via a private testing centre.
• Any visits to AMBER list countries MUST be reported upon arrival.
• You will be required to self isolate for 5 days and take a further PCR test on the fifth day, and remain self isolated until results from the second test are received.
• You are NOT permitted to use public transport apart from official Gibraltar Taxis tan be booked via phone or email on Tel: (+350) 20070027 / email: [email protected]
• You may be contacted during your stay to ensure you are complying with COVID-19 regulations.

Arriving from a RED list country OR have visited an RED list country within 14 days:

• Any visits to RED list countries MUST be reported upon arrival.
• You will be required to self isolate for 10 days and take a further PCR test on the tenth day, and remain self isolated until results from the second test are received.

WHAT ARE THE REQUIREMENTS FROM EACH TIER COUNTRY? (fully vaccinated)

• Visitors must carry out a Free of Charge LFT upon arrival
• Visitors must also fill in a passenger locator form
• Visitors must carry out a LFT upon arrival costing £30
• Arrivals will also be required to carry out a further LFT on Day 5.

Arriving from an RED list country OR have visited an RED list country within 14 days:

• Visitors must carry out a COVID-19 PCR test
• Arrivals will also be required to carry out a further COVID-19 PCR test on Day 5.

FERRY ARRIVALS

• Passengers will be limited to just 200 in the Cruise Terminal at any one time
• Terminal doors will be left open to provide air flow throughout
• Two metre social distancing will be enforced
• A maximum of four people will be allowed in the toilet facilities at any one time
• Hand sanitisors will be mandatory for anyone entering or leaving the toilet facilities

Despite the Rock being partially open for hikers, various other attractions remain closed until further notice, such as the Gibraltar Nature Reserve and other Upper Rock tourist attractions, except for the Skywalk.

Throughout Gibraltar, mask use is also mandatory in enclosed spaces such as public transport and in shops, and many restrict volume of customers.

Visa Waiver - Sponsor

Persons resident in Gibraltar can apply to sponsor for a maximum period of 21 days any person who holds leave to remain in any member state of the EU, which is part of the Schengen acquis, for more than 3 years. Please download and complete the form below and present it at our headquarters together with your passport/ID card, proof of residence in Gibraltar and a photocopy of the visitor’s passport and residence card at least one working day before the arrival of your visitor.

To apply for a visa for any other Overseas Territory or Commonwealth country, you will need to check their own website or contact their nearest Embassy or diplomatic post for advice on how to apply.

We can only process applications in countries listed above where the British Overseas Territory or Commonwealth country has no visa issuing post, for example an Embassy, Mission, Consulate or a visa application centre.

If the UK has no visa issuing post in the country where you are applying, we may still be able to process your application. Your application would need to be couriered from the nearest UK visa application centre and additional courier charges may apply. Where there are local restrictions to couriering passports out of country, you will need to apply in person to the nearest British Overseas Territory or Commonwealth country or visa issuing post.

1. Before you apply

Before you apply, you should check the visa requirements for the territory or Commonwealth country you are travelling to. As we are unable to offer any advice regarding visa requirement, you should contact the relevant British Overseas Territory or Commonwealth country of your destination.

2. How to apply

If you are travelling to one of the 5 British Overseas Territories or 2 Commonwealth countries listed above, and there is no local representation to apply for your visa, you must complete and submit a UK visa application form online and select the reason for visit as ‘other’ and the visa type as ‘Overseas Territory & Commonwealth’ to proceed.

3. Book an appointment

When completing your online application form , you will need to pay a handling fee. Once you have completed this part of the online process, you will then need to book an appointment at your nearest UK visa application centre.

If you are part of a family or group, each member of the family or group must make an individual application and individual appointment. For example, if you are a family of 4, with 2 adults and 2 children you must make 4 individual applications and 4 individual appointments.

After you have completed your online application, you will receive an email message containing your application number (also known as a ‘GWF reference’). Please make a note of this number.

4. Visa application centre

To complete the application process, you must attend your appointment at the visa application centre on the date, time and location you have selected.

You should take with you:

• a copy of the appointment confirmation
• the printout of your completed online visa application form, signed by you
• your valid passport
• 1 recent passport-sized (45mm x 35mm) colour photograph of your face, which meets the requirements in our photograph guidance
• any supporting documents relevant to your application and a photocopy of each document including English translations

We or the visa application centre, are unable to advise which supporting documents to bring with you. Any advice regarding supporting documentation should be sent to the country of your destination.

5. Waiting times

As we may need to refer your application to the British Overseas Territory or Commonwealth country you are intending to visit, the actual processing time will depend upon the issuing authority in your chosen destination. We are unable to provide a timescale as to how long this may take.

Does my UK BRP allow entry into any other country?

You cannot use your UK Biometric Residence Permit (“BRP”) to enter any country other than the UK.

The BRP is not a travel document, but proof of your immigration status in the UK. However, it may allow you to travel to some countries without needing a separate visa.

If you are planning to travel to another country, check if you need a visitor or work visa, or if you have to meet any other specific requirements before departing from the UK. This information can usually be found on the relevant country’s government website, or by contacting the embassy of the country in question.

Please ensure you take your BRP with you when travelling, as you will need it to re-enter the UK. If you lose your BRP while abroad or it is stolen, you must report the matter to the police. You must then make an application for a replacement BRP visa and you cannot return to the UK until this visa has been issued to you. This can currently take several weeks.

Where Can I Travel With a UK Student Visa?

If you are studying on a UK Student Visa , and want to travel abroad either during vacations or even during your studies, it's not a big deal. UK visas allow visa holders to travel visa-free in multiple countries of the region. But for this purpose, you need to consider all the policies and requirements for moving to another country as there are limitations and additional visas that you may require for travelling to another country.

The best way to travel abroad on a study visa is to adjust the schedule so that you don't have to skip any classes as your low attendance can impact your visa because of regular monitoring. But, in case when you have to travel on an urgent basis, during your academic year, you must inform Visa Compliance and your tutor.

Which countries can you visit with a UK student visa?

Multiple UK visas offer a visa-free trip to various countries. Tier 4 student visa also allows overseas students to travel across the UK without further needing another visa specific to that country. In addition to Schengen countries, you can travel to these countries;

• Schengen countries
• European countries 
• Caribbean, North, Central, and South American countries
• Asia and Middle Eastern countries 

Countries in the Schengen space

The Schengen area is an area in Europe, comprising 26 countries that have officially abolished all the passports and other border requirements for their mutual borders to make travel across each country passport or visa-free. 

Important Points;

• If you are studying in the UK and want to travel to Schengen space, you have to check whether your country of origin is listed among the countries that can visit Schengen countries without a separate visa or not.
• If your country is among visa-free countries, you can surely travel to Schengen countries on a UK study visa. If not, then you will have to apply for a Schengen visa and you can travel to all 26 countries on a single visa.

The 26 countries in the Schengen space include; Austria, Belgium, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Iceland, Italy, Latvia, Liechtenstein, Lithuania, Luxembourg, Malta, The Netherlands, Norway, Poland, Portugal, Slovakia, Slovenia, Spain, Sweden, Switzerland.

European countries you can visit on a UK study visa

The countries present in Europe that you can visit without a separate visa for each country include;

Albania, Georgia, Gibraltar (British territory), Ireland, Montenegro, North Macedonia, Serbia, Romania, Turkey

Caribbean, North, central, and south American countries

Other countries that you can travel to on a study visa for UK are Mexico, Anguilla, Panama, Antigua and Barbuda, Aruba, Bahamas, Peru, Bermuda (British territory), Bonair (Dutch territory), British virgin islands (British territory), Cayman Islands (British territory), Dominican Republic, Curacao, Jamaica, Sint Maarten, Turks and Caicos (British territory, Costa Rica.

Other Places to Travel 

Being present in the UK, on a UK student visa , you can surely visit all parts of the United Kingdom including England, Wales, Scotland, and Northern Ireland. Also, the Isles of Man and the Channel Islands (British Crown Dependencies) can be visited on this visa.   

Eligibility Criteria for Travelling Abroad on a UK Student Visa

You are eligible for visa-free trips to several countries when you have;

• A passport and BRP valid for at least three months after the expiry date of your visa
• Two empty pages in your passport for visa affixation 

Required Documents 

You must have a specific Visa and other documents to travel abroad. Documents requirement depends upon the locality you want to visit, either inside the UK, outside the UK, or within Schengen space. General Documents include;

• Your BRP (Biometric Residence Permit)
• Police Registration Form 
• A Complete Application
• Enrollment Letter
• A Bank Statement

Losing your travel documents could prevent or delay your ability to return to the UK, which could have an effect on your academic career. We advise that you keep a copy of your passport and immigration documents on hand as backups in addition to keeping your originals safe while visiting abroad.

Whether you want to travel within the UK or outside the UK, you need a Visa Letter. You can request this letter to travel abroad while studying. Sussex issues this letter; it supports your application. Make sure that you have mentioned the reason for travelling in this letter.

How to Apply to Travel Abroad on a UK Student Visa

To apply for a travel visit to any of the countries that you are allowed to visit on a study visa in the UK without further requirements of the visas; 

• Visit the official website of the UK-based embassy of that country
• Try to contact them via email or phone number provided on the website

You must complete an application depending on the country you intend to visit. The majority of embassies use outside organizations to handle visa processing. Some might require extra fees.
