Credit Card Processing 101 for Travel Agencies

If you’re a travel advisor, one of the most significant touchpoints for legal risk involves how you handle client payment information. As the booking agent for hotels, resorts, tour operators, cruise lines, and airlines, you’re not the actual provider of travel services, but you’re still on the hook for payments you make with suppliers or which you process yourself.

There are two primary ways travel advisors can make payments for a client's trip that we'll cover:

  • Direct Payments: One way is to accept payments directly from the client and then pay the suppliers from the agency's business bank account .
  • Credit Card Authorization: The second way is to use a PCI-compliant credit card processing program to make payments with the clients' credit card.

If a client disputes a charge with their bank, the amount of that disputed charge could come out of your pocket, so it’s a good idea to make sure you’ve got processes in place to protect you.

Accepting Direct Payment from Clients

There’s a significant amount of legal risk attached to accepting payments for tours, cruises, hotels and resorts, and airfare directly from clients.

Accepting direct payments from clients is the exception, not the rule. Why? There’s a significant amount of legal risk attached to accepting payments for tours, cruises, hotels and resorts, and airfare directly from clients.

Due to this inherent risk, most host agencies prohibit their clients from taking payments for travel products directly from travelers. For agencies that don’t have that restriction, there are two primary reasons advisors might accept direct payments for travel from clients:

1. Net Rates: Some agencies take net rates from suppliers, which they mark up and re-sell to their clients.

2. Bundling Payments from Different Suppliers: Agencies may bundle payments from different suppliers and run the charge through their accounts to charge one price to the client, in one transaction.

If you do either of these things, you may be treading into “tour operator” territory , and you’re definitely taking on additional legal risk. If you’re an agency that does this, you should make sure that you’re not in violation of your obligations to your host agency if you have one.

If you’re thinking of using Paypal or Square, think again. Those payment processors’ terms of service specifically exclude high-risk transactions.

You’ll also want to make sure that you have a merchant account with a payment processor that is approved for high-risk charges since travel is considered a high-risk industry – and those merchant accounts may be expensive and difficult to get.

Do these considerations apply to service and/or consultation fees?

You don’t need a high-risk payment processor to run a charge for service or consultation fees.

None of the above about accepting direct payment applies to planning or service fees. Fees aren’t payments for actual travel – they’re payments for professional services. You don’t need a high-risk payment processor to run a charge for fees.

Your host may allow you to accept fee payments directly. There’s much less legal risk attached to taking a direct payment for fees so long as you’re in compliance with your hosting agreement and Seller of Travel laws .

You can absolutely accept a direct payment for fees and feel good about that. But if you’re running payments for tours, cruises, hotels, and airline tickets through your bank account, that’s another matter, and you should be aware that you’re taking on considerable risk.

Can I Accept Direct Payments as a Hosted Advisor?

If you’re a hosted advisor, your contractual obligation to your host agency likely prohibits you from accepting direct payments from your clients (possibly with the limited exception of service fee payments .)

There’s a reason for that. If the money a client pays flows through your bank account, you’re taking on a lot of potential liability. T he cleanest way to make payments to a supplier is to use your client’s card to make a payment directly with a supplier. For that, you’re going to need a rock-solid credit card authorization, and you’ll need to get one for each and every charge.

Using a Credit Card Authorization Form

Many advisors will take a credit card number over the phone, or accept an email authorization . . . Here’s why that’s a problem.

Even if you have a great relationship with your clients, you shouldn’t cut corners when accepting payment authorizations. Many advisors will take a credit card number over the phone, or accept an email authorization from the client saying, “Just charge my card that you have on file.”

Here’s why that’s a problem.

If your client decides to dispute a payment that you made with their card, they’re essentially telling their bank that it’s a fraudulent charge. In this scenario, the supplier is going to need to see proof from you that you had authorization from the client to make that charge using that card. If you can’t provide sufficient proof of authorization to the supplier, the supplier can’t defend the chargeback, and it’s likely that you’ll be debited for the amount of the disputed charge.

That’s why you should be getting an authorization for every single charge you make using your client’s credit card. The authorization should accomplish three things:

1. Identify the card being used

2. Indicate the amount of the charged

3. Include the date of the authorization

Additionally, the credit card companies are now requiring that the client agrees to the booking terms and conditions at the time of authorization and that the cancellation and refund policies are brought to the client’s attention at the time the payment is made. That’s a lot of info to put into a credit card authorization statement, but you’ll need one for every transaction you put through.

Using a Tech Tool for Credit Card Authorizations

A good tool gives you the ability to send a detailed invoice for client approval and allows you to save a record of all client authorizations in your system.

Since you’ll need to get an authorization for each transaction you process, it’s worth considering investing in a technology tool that will make it easy for you to get those authorizations. This will make it easy for your clients to authorize those charges.

You might have to subscribe to a CRM platform in order to access those tools — but consider it a cost of doing business. Spending $50 a month for a tool that protects you is a lot more affordable than losing a credit card chargeback and having to pay for $10,000 of your client’s vacation.

When you’re looking at those tech tools, make sure that it complies with PCI (Payment Card Industry) data compliance standards. Taking a card number by email or (even worse) text message, or storing card numbers in an unencrypted spreadsheet or database is extraordinarily risky.

If your unencrypted system for storing and holding numbers gets hacked, your clients could become victims of identity theft, and you could wind up having to pay a lot of money to comply with laws governing the clean-up in the aftermath of a data breach. Again, investing in a PCI-compliant tech tool is a no-brainer. My recommendation? Spend the money, learn how to use it, and use it consistently.

About Those Terms and Conditions

Remember how we mentioned your terms and conditions when we talked about credit card authorization language? Well, maybe we were putting the cart before the horse, but … You do have a terms and conditions document, don’t you? If not, now’s the time to put something in place.

Your terms and conditions statement is the baseline for every trip you book for your clients. You'll want to have your clients affirmatively agree to your terms when booking travel for them — either as part of a client agreement, when authorizing credit card payments, or both.

The terms and conditions you have in place will protect your business from all sorts of legal risk, everything from complying with government regulations to limiting your liability for supplier errors to making advisories to clients about risks of travel…and much more.

Where chargebacks are concerned, one of the provisions that you’ll want to put in your terms is a provision where your client agrees that they won’t dispute charges they have authorized, except in cases of fraud. Obviously, you can’t restrict a client from disputing fraudulent charges, but if they’ve authorized you to pay the supplier for their vacation, and then they try to dispute the charge, you don’t want the amount of that charge coming out of your pocket.

In a high-risk industry, a one-size-fits-all approach is not going to be as useful as having something fine-tuned to the specifics of your business.

If your clients have agreed to such a provision in your terms document, you could (if you needed to) go to court to recover the amount that you were damaged. Essentially, you’d show the court your terms, where the client agreed to those terms, where the charge was authorized, and proof that you were damaged. Obviously, no one wants to be in the position of having to sue a client, but if you have a client that disputes a significant charge as a way of getting out from under a supplier policy they don’t like, you shouldn’t have to pay for that.

If you don’t have a well-crafted terms and conditions document already in place, it’s time to fix that. There are some cookie-cutter documents and templates floating around out there, including some that you can purchase. But I have a strong view that in a high-risk industry, a one-size-fits-all approach is not going to be as useful as having something fine-tuned to the specifics of your business.

A business that does a lot of school groups will need slightly different terms than someone who books a lot of adventure travel. Before you spend money buying a cookie-cutter document, consult with an attorney who knows the travel and tourism industry about what it would take to protect your business adequately. Scary? It Doesn’t Have to Be.

Selling travel is a high-risk business and a lot of that risk centers around how you handle your client’s payment information. The good news is that all of that risk can be managed if you avoid taking payments directly from clients, have a solid credit card authorization, use a PCI-Compliant tech tool, and have a well-crafted terms and conditions document.

By completing, signing and returning this credit card authorization form (“Authorization”) to Wanderlust Travel Consultants, LLC (“WTC”), you are authorizing WTC to charge your Credit Card (defined below) for any and all charges and fees related to the Travel (defined below). Upon satisfaction of all amounts due and owing to WTC related to the Travel (as well as any other obligations under this Authorization or related to the Travel), this Authorization will be destroyed and no copies of it will be retained by WTC. 

Scope of Authorization:

Credit Card Authorization Form

Client acknowledges that this agreement will remain in force until such time as canceled by Client in writing to L & B Travel, LLC. Client also acknowledges that if any of the cards listed above are canceled or an authorization for the charge is declined, Client will pay any amounts outstanding for the services provided by L & B Travel, LLC.

1. MINIMUM SERVICE FEE – Client agrees to pay a nonrefundable service fee for engaging L & B Travel, LLC, which fee is payable upon signing this authorization. This service fee is owed regardless of whether client actually books any travel reservation or even if Client cancels a reservation. There are 4 levels of service fees:

a) for services involving a simple roundtrip airline ticket from destination A to destination B, the service fee is $75 per person;

b) for air-only services more than a simple roundtrip ticket from destination A to destination B, the service fee is $75 per ticket, per person;

c) for services that combine any combination of air, hotel, rail, car, or tour services, the service fee is approximately $175-250 per person depending on the complexity of trip; and

d) for services that include mileage redemption services in conjunction with travel arrangements for air, hotel, rail, car, or tour services, the service fee starts at $275 per person.

2. AGENCY – Your attention is drawn to the fact that L & B Travel, LLC, is a travel agency and as such acts only as an agent and never as a principal. It acts as an agent for its suppliers, including, but not limited to, all airlines, tour operators, other transporters, providers of accommodation and/or other services, insurers, and dealers in foreign currency. All business which it transacts is on behalf of its principals and accordingly any claim which any customer may have arising out of any business transacted by or through L & B Travel, LLC, will lie against the principal and not against L & B Travel, LLC. Seat assignments on plane can be requested, but never guaranteed. Passenger can log-in onto respective airline website to check or modify seat assignments. It is ultimately the responsibility of the passenger to check most current flight schedules prior to departure. Often, airlines can make unexpected schedule changes or cancellations that are not always reflected in the travel agent reservations system and agent is not notified of these changes. If you are having trouble confirming a flight time, please ask your travel agent for assistance.

3. TRAVEL INSURANCE – We strongly urge (and often make mandatory) travel insurance for all travelers, particularly considering the majority of airlines and tour operators have extremely high cancellation/date change penalties. Travel insurance should be purchased at time of deposit or payment for travel arrangements. We believe high medical insurance and emergency evacuation coverage is essential during travel. We do not feel credit card travel insurance is adequate coverage, especially with regard to comprehensive medical coverage and cancellation coverage. Please check with us for further details, but note that we are not insurance experts and accordingly do not make any warranty concerning the adequacy or extent of any coverage under any policy which we sell. Customers are advised to read and become acquainted with the policy documents, and any queries should be directed to the insurer for clarification. 4. PASSPORTS – You must arrange your own passport with atleast a 6-month validity past your complete travel dates. L & B Travel, LLC, bears no responsibility for incorrect/invalid passport, incorrect passport names provided for Airline tickets or any other immigration documentation.

5. VISAS – Visas are required for entry into many countries, and it is the responsibility of the customer to check with the consulate of each country to be visited in order to establish its visa requirements.

6. HEALTH – See your local doctor for recommended medical and vaccination advice.

7. CANCELLATIONS – Any change to a reservation (date change, rerouting, etc.) constitutes a cancellation. Please be advised that cancellations incur charges. To change a single component of your reservation after trip has been booked and confirmed a $75 per person service fee will apply. To cancel an itinerary entirely, a $175 per person service fee will apply. Client acknowledges that fees imposed by the airline, hotel, rail, car, or tour operator due to a cancellation can be up to 100% of the total trip cost purchased. These fees are in addition to the Minimum Service Fee described in paragraph 1. Please note that airline/wholesaler refunds can take up to twelve (12) weeks.

8. INCREASES – Please note that all airfares and tour operator rates are subject to change without notice until payment has been made in full. L & B Travel, LLC, therefore cannot warrant that prices will not change and any increase must be borne and paid for upon demand either by L & B Travel, LLC, the airline, the tour operator or the supplier of the service.

9. PASSENGER AND CREDIT CARD AMENDMENTS – In the best interests of the client, it is crucial to inform L & B Travel, LLC, immediately of any changes to the passenger list and to review the list on a regular basis. Please provide L & B Travel, LLC with current and valid credit card information once credit card on file has expired or is no longer a valid card. This form will also be kept on file to serve as credit card authorization for all other travel arrangements made with L & B Travel, LLC.

10. DISCLAIMER OF LIABILITY – The attached Important Notice to Client/Disclaimer of Liability is made a part of this Credit Card Authorization Form. L & B Travel, LLC (the “Company”) , is not itself a tour operator, carrier or hotelier, nor do we own aircraft, hotels, or coaches. We exercise every care in the selection of reputable service providers, which term includes but is not limited to tour operators, airlines, coach operators, hotels, cruise-line operators and shipping, rail, car hire and restaurant operators (“Service Providers”), which we recommend or which are used in tours which we sell. All bookings are subject to the terms and conditions and limitations of liability imposed by these Service Providers, some of which limit or exclude liability in respect of death, personal injury, delay, and loss or damage to baggage.

We always do our best to make sure your travel arrangements are satisfactory. But we cannot accept any liability of whatever nature, whether in contract, tort, or otherwise, for the acts, omissions, or default, whether negligent or otherwise, of the Service Providers, over which we have no control.

We do not accept any liability in contract, or otherwise, for any injury, damage, loss, delay, additional expense, or inconvenience caused directly or indirectly by force majeure or any other event which is beyond our control or which is not preventable by reasonable diligence on our part. We strongly recommend that you take out travel insurance against these risks.

It is your personal responsibility to ensure that you have valid documentation, including but not limited to a valid passport and required visas, which meet the requirements of immigration and other government authorities at all destinations. Any fines, penalties, payments, or expenditures incurred as a result of such documents not meeting the requirements of such authorities will be your sole responsibility.

It should be noted that all documents issued to travelers are non-transferable. Such documents may include, but are not limited to, airline tickets, hotel vouchers, tour vouchers, or any other document used to confirm an arrangement with a Service Provider.

Such documents may also be subject to conditions such as, but not limited to, being non-refundable, non-date-changeable, and subject to cancellation or amendment fees. It is your responsibility to familiarize yourself with these conditions.

ACKNOWLEDGEMENT & CREDIT CARD TRANSACTIONS

In entering into this transaction, you acknowledge that: 

  • The Company acts as a travel agent only; 
  • The Company’s obligation to you is to make travel bookings on your behalf and to arrange relevant contracts between you and Service Providers; 
  • Once the Company has made your travel arrangements for you, it has provided you fully with the service which it is obliged to supply;
  •  All moneys received by the Company from you in respect of travel services are received by the Company as agent of the Service Provider; 
  • If for any reason any Service Provider is unable to provide the services for which you have contracted, your remedy lies against that Service Provider and not against the Company; and 
  • In the event that Payment has been made to the Company by credit card, you agree that you will not seek to chargeback or recover your payment or any other losses from the Company.

The Company respects the privacy of its customers. The personal information the Company collects is used for the purpose of meeting your travel requirements. The personal information the Company collects may include your name, address, phone number, e-mail address, credit card details (where you provide them), and any further information you volunteer to us.

Where necessary to fulfill your requested travel requirements, we will provide personal information you provide to us, to airlines, tour companies, care hire agencies, hotels, restaurants, insurance providers, and commercial partners. Please be assured we will not disclose any personal information for any other purpose without your consent, except where the use of disclosure is required or authorized by or under law.

The Company takes reasonable steps to protect any personal information it holds under law. The consequence of your not providing any information requested by the Company is that the Company may not be able to complete your travel arrangements, nor will it be able to contact you to advise of changes to your travel details.

    • As soon as Your card is charged the amount of the deposit, a payment confirmation will be e-mailed to You.
    • The balance due (if any) is to be paid upon arrival.
    • If You cancel your booking, You will be charged the cancellation fee according to our Cancellation Policy.

    • Visa Support & Transfers. Any cancellations cause a fee equal to 100% of the total price.
